SolidWeb Dialup Service Terms
Solid Technology, Inc. agrees to
provide and customer agrees to receive SolidWeb Internet services
according to the following terms and conditions:
1. SERVICES
PROVIDED. SolidWeb access provides Internet
connectivity and e-mail utilizing Solid Technology
communication, network and data processing facilities. Customer may
access the Internet as often as desired subject to the monthly limit,
if any, on usage hours. To insure superior service for all users,
multi-user LAN connections and any type of virtually continuous
connections are not permitted.
2. DISCLAIMER
OF WARRANTY. Solid Technology maintains appropriate
equipment and personnel to provide premium services, however CUSTOMER
EXPRESSLY AGREES THAT USE OF ANY SERVICE IS AT CUSTOMER'S SOLE RISK.
SERVICE IS PROVIDED WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR
IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF NON INFRINGEMENT,
MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. SOLID TECHNOLOGY
AND ITS AFFILIATES MAKE NO WARRANTIES THAT ANY SERVICE WILL BE ERROR
FREE OR UNINTERRUPTED AND MAKE NO WARRANTIES OR ENDORSEMENTS WITH
REGARD TO ANY MATERIAL, MERCHANDISE, INFORMATION OR SERVICE PROVIDED
THROUGH THE INTERNET.
3. LIMITATION
OF LIABILITY. NEITHER SOLID TECHNOLOGY NOR ANY OF ITS
AFFILIATES OR INFORMATION PROVIDERS SHALL BE LIABLE FOR ANY DIRECT,
INDIRECT, OR CONSEQUENTIAL DAMAGES INCLUDING LOSS OF SERVICE, LOSS OF
DATA, UNAUTHORIZED ACCESS, COMPUTER VIRUS DAMAGE, LOSS OF INCOME OR
ANY DAMAGES THAT RESULT FROM CUSTOMER'S RELIANCE ON SOLIDNET SERVICE.
CUSTOMER'S SOLE AND EXCLUSIVE REMEDY FOR ANY CLAIM WHATSOEVER IS
IMMEDIATE TERMINATION OF THIS AGREEMENT.
- LAWFUL USE. SolidWeb service
may only be used for lawful purposes. Transmission of any material in violation
of any US or State regulation is prohibited. Customer warrants that any
material submitted for publication through customer’s account does not infringe
any copyright, trademark, patent or proprietary rights of others, nor shall
it contain any material legally judged to be obscene, threatening, libelous
or classified by the US government. Customer agrees to indemnify and hold
harmless Solid Technology, Inc. from any claims resulting from customers
use of the service. Solid Technology reserves the right to monitor and control
access and content as necessary to operate the system or comply with applicable
law.
- HARMFUL USE.
Customer shall not transmit any information which contains a virus
or other harmful components or use the service in any way which
restricts or interferes with others use and enjoyment of the
system or the Internet. Transmission of unsolicited commercial
e-mail is expressly prohibited. Any attempted unauthorized access
or interference with the normal system operation of Solid
Technology or interference with any computer system accessed via
SolidNet service will result in immediate termination of
customer’s service without refund.
- PAYMENT. Customer agrees to pay Solid Technology
charges for services as indicated. SolidWeb access fees are prepaid and
will be charged in advance each month. Solid Technology policy is to make
reasonable efforts to contact customer if payment is not received when due,
however customer acknowledges that service may be terminated without notice
in the event of non-payment.
- TERMINATION. This agreement shall remain in effect for 30
days from the enrollment date shown and shall be automatically renewed for
successive 30 day periods. Solid technology may change prices or terms with
30 days notice to customer. Either party may terminate the agreement without
cause at any time.
